REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE
NUMBER PER-56/BC/2012

CONCERNING
TRYOUT OF AUTOMATIC GATE SYSTEM IMPLEMENTATION OF TEMPORARY STORAGE (AUTO GATE SYSTEM) AT CUSTOMS AND EXCISE MAIN SERVICE OFFICE TYPE A OF TANJUNG PRIOK

THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE,

Considering:

a. That at Temporary Storage in the Customs and Excise Main Service Office Type A of Tanjung Priok area has been conducted online TPS system and has been applied fully (mandatory) on some activities in Temporary Storage;

b. That in order to improve the wider utilization of the Online TPS system in the effort to improve service and control on the entry and releasing of goods to and from Temporary Storage, it is necessary to develop TPS Automatic Gate Systems;

c. Based on the considerations as intended in paragraphs a and b, it is necessary to stipulate Regulation of the Director General of Customs and Excise concerning Tryout of Automatic Gate System Implementation of Temporary Storage (Auto Gate System) at Customs and Excise Main Service Office Type A of Tanjung Priok;

In view of:

1. Law Number 10 of 1995 concerning Customs (Statute Book of the Republic of Indonesia Number 75 of 1995, Supplement to Statute Book of the Republic of Indonesia No. 3612), as amended by Law Number 17 of 2006 (Statute Book of the Republic of Indonesia Number 93 of 2006, Supplement to Statute Book of the Republic of Indonesia Number 4661);

2. Law Number 11 of 1995 concerning Excise (Statute Book of the Republic of Indonesia Number 76 of 1995, Supplement to Statute Book of the Republic of Indonesia Number 3613), as amended by Law Number 39 of 2007 (Statute Book of the Republic of Indonesia Number 105 of 2007, Supplement to Statute Book of the Republic of Indonesia Number 4755);

3. Regulation of the Minister of Finance Number 70/PMK.04/2007 concerning Customs Area and Temporary Storage;

4. Regulation of the Director General of Customs and Excise Number P-20/BC/2007 concerning Implementation Guidelines of Customs Area and Temporary Storage Determination;

5. Regulation of the Director General of Customs and Excise Number P-41/BC/2009 concerning Trial Implementation of Electronic Data Interchange between Temporary Storage with the Directorate General of Customs and Excise at Customs and Excise Main Service Office of Tanjung Priok;

6. Regulation of the Director General of Customs and Excise Number P-54/BC/2010 concerning Procedure of Electronic Data Exchange at Temporary Storage;

7. Decision of the Director General of Customs and Excise Number KEP-92/BC/2010 concerning the Application of Online Temporary Storage at Customs and Excise Main Service Office of Tanjung Priok;

DECIDES:

To stipulate:

REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE CONCERNING TRYOUT OF AUTOMATIC GATE SYSTEM IMPLEMENTATION OF TEMPORARY STORAGE (AUTO GATE SYSTEM) AT CUSTOMS AND EXCISE MAIN SERVICE OFFICE TYPE A OF TANJUNG PRIOK.

CHAPTER I
GENERAL PROVISIONS

Article 1

In this Regulation of the Director General what is referred as:

1. Temporary Storage hereinafter abbreviated as TPS is building and/or field or other such place in the customs area temporary to pile goods while waiting for loading or releasing.

2. Electronic Data Interchange hereinafter abbreviated as PDE is the flow of business information electronically among applications, among organizations directly integrated through a computer network.

3. Service Computer Systems of Temporary Storage hereinafter abbreviated as SKP TPS is a computer system used by the Customs Office in the framework to control and service customs in TPS.

4. Online Temporary Storage System hereinafter called as Online TPS System is PDE system between Customs Office with TPS of the data relating to the entry and releasing of goods to and from TPS.

5. TPS Automatic Gate System is a system of entry or releasing goods automatically to and from TPS has applied Online TPS.

6. Director General is the Director General of Customs and Excise.

7. Customs and Excise Official is employee of the Directorate General of Customs and Excise appointed in certain positions to perform certain tasks based on Customs Law.

CHAPTER II
SCOPE

Article 2

(1) The tryout application of TPS Automatic Gate System implemented the TPS in the working area of Customs and Excise Main Service Office Type A of Tanjung Priok.

(2) In the framework of the implementation of the tryout as intended in paragraph (1), the Director General determines TPS after TPS entrepreneur files an application to the Director General and fulfill technical requirements.

(3) The determination as intended in paragraph (2) shall applied for a period of 6 (six) months and may be extended.

(4) The technical requirements as intended in paragraph (2) at least include:

(5) Fulfillment with technical requirements as intended in paragraph (4) will be assessed by the technical team determined by the Director General.

(7) Technical Team as intended in paragraph (6) is coordinated by the Directorate of Information of Customs and Excise.

Article 3

Tryout application of TPS Automatic Gate Systems as intended in Article 2 paragraph (1) includes entry and releasing activities into and from TPS, based on the results of Online TPS system PDE between the Main Service Office of Customs and Excise Type A of Tanjung Priok and determined TPS.

CHAPTER III
RELEASING AND ENTRY OF GOODS INTO AND FROM TPS

Part One
Releasing from TPS

Article 4

(1) Releases of goods from TPS conducted through TPS Automatic Gate Systems after obtaining the approval from the Official of Customs and Excise or service computer systems.

(2) The approval as intended in paragraph (1) include:

Article 5

(1) Entry of goods to the TPS conducted through TPS Automatic Gate Systems after obtaining the approval from the Customs and Excise Official or service computer system.

Article 6

(1) TPS entrepreneur that is determined as intended in Article 2 paragraph (2) check the suitability of the data elements of approval as intended in Article 4 paragraph (2) or Article 5 paragraph (2) between the data elements submitted by the SKP TPS with Online TPS System and data elements submitted by applicant on the entry or releasing of goods.

(3) In case of the checking as intended in paragraph (1) appropriate, the entrepreneur shall issue approval on the entry or releasing of goods then submit it to SKP TPS through Online TPS System.

Article 7

(1) TPS entrepreneur serves the entry or releasing of goods after matching the quantity and size of containers and/or packaging with the approval of the entry or releasing as intended in Article 6 paragraph (3).

(2) TPS entrepreneur has responsibility for appropriate between the entered goods or released goods with approval of the entry or releasing of goods as intended in Article 6 paragraph (3).

Part Four
Sealing and Guarding

Article 8

(1) TPS Entrepreneur receives information through Online TPS system on:

Article 9

(1) Entry or releasing of goods are given approval by TPS Entrepreneur as intended in Article 6 paragraph (3) conducted without approval notes from Customs and Excise Official who supervises entry and releasing of goods.

(2) Data of the entry and releasing of goods are submitted through Online TPS system and print out of TPS Automatic Gate System become evident for realization of the entry or releasing of goods to and from the Customs Area.

(3) Goods obtain approval for the entry or releasing from TPS entrepreneur as intended in Article 6 paragraph (3) can be prevent by Customs and Excise Official in case there is indication of violation in the field of customs and/or excise.

CHAPTER IV
OTHER PROVISIONS

Part One
Contingency

Article 10

In case of service computer system not working and/or faulty, Customs and Excise Official is recording entry and/or releasing of goods approval manually into the application system connected to the Online TPS.

Article 11

(1) In case of online TPS system not working and/or faulty, TPS Entrepreneur asks confirmation to Customs and Excise official on the approval of the entry and/or releasing of goods.

(2) Customs and Excise Official gives confirmation on the correctness of data related to the approval of the entry and/or releasing of goods to TPS Entrepreneur based on service computer systems.

(3) Based on the confirmation as intended in paragraph (2), TPS Entrepreneur records approval number of the entry and/or releasing completely in TPS Automatic Gate Systems.

Article 12

(1) In case of TPS Automatic Gate Systems not working and/or faulty, TPS Entrepreneur asks confirmation to Customs and Excise official on the approval of the entry and/or releasing of goods.

(2) Customs and Excise Official gives confirmation on the correctness of data related to the approval of the entry and/or releasing of goods to TPS Entrepreneur based on service computer systems.

(3) Based on the confirmation as intended in paragraph (2), TPS Entrepreneur serves the entry and/or releasing of goods manually.

(4) TPS Entrepreneur records approval realization of the entry and/or releasing of goods manually as intended in paragraph (3) after TPS Automatic Gate Systems work/run.

(5) TPS Entrepreneur submits approval realization of the entry and/or releasing of goods as intended in paragraph (3) through Online TPS.

Others

Article 13

The provisions on the entry and releasing of goods to and from Temporary Storage are governed in this Regulation of the Director General make exception for the provision on the entry and releasing of goods to and from Temporary Storage as has been stipulated in the provisions on the:

Head of Main Service Office of Customs and Excise Type A of Tanjung Priok can determine further technical guideline for the implementation of tryout TPS Automatic Gate Systems.

Article 15

Tryout implementation of TPS Automatic Gate Systems will be evaluated periodically by the Technical Team as intended in Article 2 paragraph (5).

CHAPTER V
CLOSING PROVISION

Article 16

This Regulation of the Director General shall come into force on stipulation date.
